Acceptable Use Policy (AUP)

1. Introduction
This Acceptable Use Policy ("AUP") governs the use of the voice, messaging, and related telecommunications services ("Services") provided by Fusioncom LLC ("Fusioncom", "we", "us", or "our"). This AUP applies to all customers, users, resellers, and wholesale partners ("Customer", "you", or "your") who access or use our Services.
By utilizing our Services, you agree to comply with this AUP. Fusioncom reserves the right to modify this AUP at any time. Continued use of the Services after modifications constitutes your acceptance of the revised AUP.
2. Compliance with Applicable Laws
Customers must use the Services in strict compliance with all applicable local, state, national, and international laws, regulations, and industry guidelines. This includes, but is not limited to:
The Telephone Consumer Protection Act (TCPA)
The Telemarketing Sales Rule (TSR)
The TRACED Act
The Truth in Caller ID Act
The CAN-SPAM Act
CTIA policies and guidelines for SMS/MMS messaging
Federal Communications Commission (FCC) rules and regulations
3. Prohibited Uses and Activities
You may not use our Services to engage in any of the following activities:
Illegal Activity: Any activity that violates applicable law, including fraud, extortion, theft, or the transmission of illegal material.
Robocalling and Spam: Transmitting unsolicited commercial telemarketing broadcasts or pre-recorded messages without prior express written consent from the recipient as required by the TCPA.
Caller ID Spoofing: Transmitting misleading, inaccurate, or spoofed Caller ID information. Customers must ensure that all outgoing calls originate with a valid, legally authorized Caller ID that belongs to the Customer or the Customer’s end-user.
Harassment and Abuse: Transmitting materials or making calls that are harassing, defamatory, abusive, threatening, obscene, or hateful.
Phishing and Social Engineering: Attempting to fraudulently obtain personal, financial, or sensitive information.
Network Interference: Any activity that adversely affects the operation of Fusioncom’s network, including denial-of-service (DoS) attacks, unauthorized packet sniffing, or intentionally overloading our infrastructure.
4. SMS & MMS Messaging (A2P 10DLC) Policies
If your use of the Services includes SMS/MMS messaging, you are strictly bound by the following requirements:
Opt-In and Opt-Out Requirements: You must obtain documented consent (Opt-In) from end-users prior to sending any messages. You must honor all opt-out requests (e.g., "STOP") immediately and permanently.
Campaign Registration: All Application-to-Person (A2P) messaging over 10-digit long codes (10DLC) or Toll-Free numbers must be properly registered with the appropriate campaign registries (e.g., The Campaign Registry) prior to operation.
Prohibited Content (S.H.A.F.T.): You may not transmit messages related to Sex, Hate, Alcohol, Firearms, or Tobacco, as well as high-risk financial services, debt collection, or illicit substances, in violation of CTIA guidelines or carrier rules.
5. Wholesale and Reseller Responsibilities
If you are a wholesale partner or reseller of Fusioncom’s Services, you are fully responsible for the activities of your end-users. You must:
Incorporate this AUP, or terms at least as restrictive, into your own agreements with your end-users.
Actively monitor your traffic for fraud, robocalling, and abuse.
Assist Fusioncom immediately in investigating trace-back requests, STIR/SHAKEN compliance inquiries, and law enforcement subpoenas.
6. Fraud Prevention and System Security
Customers are solely responsible for the security of their own internal networks, PBX systems, softswitches, credentials, and endpoints.
Toll Fraud: You are responsible for all charges resulting from unauthorized access to your systems (e.g., PBX hacking, SIP credential compromise), regardless of whether the usage was authorized by you.
Security Measures: You must implement reasonable security measures, such as strong passwords, IP whitelisting, firewalls, and rate-limiting, to prevent unauthorized access.
7. Fair Use Policy
To ensure optimal network performance for all clients, Fusioncom strictly prohibits uses that cause excessive network strain. Unless explicitly contracted for specific high-volume use cases (such as authorized dialer traffic on designated routes), the following are prohibited on standard retail/SIP trunking plans:
Autodialers, predictive dialers, or continuous uninterrupted call forwarding.
An abnormally high ratio of short duration calls (calls lasting less than 6 seconds).
Simultaneous ringing of massive amounts of endpoints.
8. Enforcement, Suspension, and Termination
Fusioncom employs automated and manual network monitoring to detect AUP violations. If we determine, in our sole discretion, that a violation has occurred, we may take any of the following actions:
Issue a warning to the Customer.
Filter, block, or drop non-compliant traffic (e.g., blocking calls with invalid Caller IDs or dropping spam SMS).
Suspend the Customer’s Services immediately and without notice.
Terminate the Customer’s account and contract.
Report the activity to the FCC, the Industry Traceback Group (ITG), or relevant law enforcement authorities.
No refunds or service credits will be issued for service interruptions resulting from an AUP violation.
